Personal Injury
If you are injured by another, you have the right to be
compensated for any damages you sustain as a result, these are called “legal
damages.” THESE ARE THE STEPS YOU MUST TAKE TO PROTECT YOUR CLAIM WHENEVER
YOU ARE INJURED.
1.
Sit down in a quite moment with your favorite
beverage and write down everything you can think of about how your injury took
place...people, places, things, events, who, what, when, where, why, etc...Do
this in the form of a narrative, as if you were writing a letter. Do this
up to, and including the day you construct it. Obviously the sooner you do
it after the event the easier it is to do.
2. Each
day after you’ve constructed the narrative, add to it in the form of a diary, as
you write, consider things juries consider in awarding monetary damages:
Pain, suffering, aggravation, inconvenience, grief, loss of enjoyment of life,
mental distress, restrictions on activities. Also consider medical bills,
prescriptions, property damage, lost wages or earnings, and any other out of
pocket expenses.
3. Do
not share this information with the parties or representatives of the parties
who caused the event or who must at some time in the future be responsible to
compensate you….REMAIN SILENT….everything you say can and will be used against
you.
4. Add
knowledge to your claim, secure the services of a lawyer who understands his
true function, to speak for you in a way that allows your information to be used
to protect your rights, enhance your chances of a fair recovery, and bring
knowledge of the legal system to your claim, to level the playing field and
allow justice to prevail.
5. The
duty of the lawyer is to represent his clients interests within the bounds of
the law. Fees for the lawyer are percentage based thereby requiring no
“retainer.”
6. Once
selected, follow the advice of your lawyer through the completion of your case
cooperating as necessary to secure the desired result.
